Rental Agreement
This Dress Hire Agreement is between The Curve Room (“We”, “Our”, “Us”) and the individual or entity renting one or more garment(s) (“You”, “Your”). By placing a hire order, You accept and agree to the terms set out below.
1. Contract Formation
By confirming your hire order with The Curve Room, you enter into a legally binding contract between yourself and us for the rental of the garment(s). If you have ordered through a third-party platform that integrates our services, the contract is with The Curve Room.
2. Payment & Fees
- You authorise us to charge your provided payment method for the rental, postage, and any additional fees (e.g., late return, damage).
- Should a charge fail, we may invoice you, which must be settled within 3 business days. Non-payment may result in booking cancellation or debt recovery.
- Disputing valid charges with your payment provider may lead to legal action to recover amounts owing.
3. Identification
We reserve the right to request valid photo identification (e.g. driver’s licence or passport) prior to confirming your order. Failure to provide acceptable ID may result in cancellation.
4. Ownership
All garment(s) remain our property at all times. You must not alter, modify or sell any hire item without prior written approval from us.
5. Rental Period
- The rental is calculated as inclusive days (e.g., a 4-day hire could include delivery on Day 1 and return on Day 4). For example, a 4-day rental period can mean that your item will arrive by Friday and you will post it back on Monday. In this example, both the Friday and the Monday are included in the 4-day period.
- Return details (e.g. prepaid satchel) will be provided with dispatch. Late returns may incur additional fees.
6. Delivery
- We aim to deliver hires as early as possible to mitigate any postage delays. Please ensure you provide a permanent address where there will be somewhere safe to leave a parcel or someone to accept the parcel up to 8 days prior to your rental period.
- We mark all parcels as authority to leave. There is still no guarantee that it will be left without signature. Australia Post makes this decision at the time based on whether they believe it is safe to do so, and this is completely out of our control. You understand and agree that by granting us authority to leave, we and our couriers are released of all responsibility and liability for the Orders delivered and left unattended, and that this responsibility and liability transfer to you on delivery.
- If you require your parcel to be signed for you must specify this in the delivery instructions at check out.
7. Late Delivery
In the vast majority of cases, your item(s) will arrive on or before your Delivery Date.
If the highly unlikely event that your item arrives too late for you to wear it, and it is returned unworn within 1-2 days of delivery, you will be provided with a refund or credit note per below:
- If your order was placed 6 or more full business days prior to your chosen delivery date, it will be a full refund (please see Definition of Refund section below).
- Otherwise it will be considered a "last-minute order" and you will have the option of a full credit note.
If your delivery fails because you have provided an incorrect or incomplete address, you will not be entitled to a refund or credit.
8. Garment Care & Damage
- You must treat the garment with utmost care, avoid forcing closures (e.g., zip), and not attempt any alterations.
- Damage beyond normal wear (e.g., broken zips, significant stains) may result in repair or replacement charges.
- Stains such as tan or makeup should be pre-treated at your discretion, but excessive staining requiring deep cleaning or replacement may incur extra cleaning charges or full RRP.
9. Cancellations & Refund Policy
All cancellations are subject to the following refund policy:
- Cancellation 14 or more days before hire start date → Full refund.
- Cancellation 7–14 days before hire start date → Credit note for full amount, valid for 6 months, applicable to any Curve Room hire.
- Cancellation under 6 days before hire start date or once the item has been dispatched → No refund or credit, unless otherwise agreed at Our discretion.
10. Returns for Fit or Damage
If the item does not fit or is damaged upon arrival:
- Notify us within 24 hours of receiving the item and return it immediately using the provided return method.
- If returning for fit, you may receive a credit note for the full amount minus a small administration and postage fee of $30.
- If returning due to damage or soiling not covered by normal wear, you will receive a credit note for the full amount valid for 6 months.
11. Refunds
For the purposes of this agreement, a refund for an order is defined as returning back to you the initial form of payment used to place that order. If you paid for the order by credit/debit card, the funds will be returned to that card. If you paid for the order using a credit note, then the amount will go back onto this credit note.
12. Cleaning & Damage
- Do not attempt to wash or dry-clean the garment(s). We handle all cleaning at our facility.
- You are responsible for non-removable stains or damage beyond normal wear—which may incur fees.
13. Delivery & Return Logistics
- Items are dispatched via Australia Post or equivalent, and you will receive a tracking number.
- A prepaid return satchel or label will be provided for returning items. Ensure that you place your garment(s) inside the self addressed and return over the counter at an Australia Post store or depot, on or before the specified booking return date, by no later than 4pm.
- With delivery of your product, pre-paid return packaging is provided. If for any reason you aren't able to attend an Australia Post store or depot to post back the item over-the-counter on the return date, you may return the parcel via a yellow Australia Post Express Post street postbox. This is at your own risk. If the parcel is lost and is never scanned by Australia Post, you may be liable for replacement. Similarly, if the item arrives back much later than expected, the date of the first scan on the tracking may be used as the date it was posted back when calculating late fees.
- If your "Return on" date falls on a Sunday or a public holiday, you may post the item on the next working day before 4pm. No late fees will apply in this instance.
- You are responsible for posting the item back within the agreed timeframe. Late return fees may apply.
14. Exceptional Circumstances
If your event is affected by circumstances beyond your control (e.g., lockdowns, event cancellations):
- If the item has not yet been dispatched, you may receive a full credit note.
- If the item has been dispatched, a credit may be issued minus postage costs, at our discretion.
15. Credit Notes
- Credit notes are non-redeemable for cash and valid for 12 months from the date of issue.
- They may be used toward future hires with The Curve Room.
16. Late Return & Unpaid Fees
- Late returns may incur daily fees or administrative charges.
- Daily fees are charged at $25 per day, up to 200% of the dresses RRP.
- We reserve the right to charge unpaid fees and pursue collection if necessary, including via debt agencies or legal channels.
- If you return your item(s) via an Australia Post Outlet, it will be scanned over the counter as proof of lodgement then you will not be responsible for late fees provided the item(s) are lodged by 4pm on your return date (or next business day if your return date falls on a Sunday or public holiday).
- If you post your item(s) via an Australia post box you will be charged $30 each day the dress is received after one (1) business day of your return date.
17. Cancellation & Modification by Us
- We may cancel or modify your order if the item becomes unavailable and will notify you as soon as possible.
- In such cases, you will receive a full refund or credit note.
18. Right to Retrieve
We reserve the right to retrieve the garment(s) at any time if necessary. You agree to facilitate any such retrieval.
19. General Provisions
- This Agreement is governed by the laws of Victoria, Australia.
- If any term is found invalid, the rest remains in force.
- Changes to this Agreement will be posted on our website. The current version applies to your order.
20. Acceptance
By placing a rental order, You confirm that you:
- Have read, understand, and agree to be bound by these terms.
- Authorise the charges as described.
- Accept our policies on cancellations, returns, and credit notes.
